Terms of Service

These terms govern your use of Fireside ("the Service"), operated by Fireside Systems Pty Ltd (A.C.N. 695827322). By creating an account or using the Service, you agree to these terms.
1. Accounts
You must provide accurate information when creating an account. Each login belongs to one person and may have access to one or more company workspaces. You are responsible for activity under your login and for keeping your credentials secure.
2. Acceptable Use
You may use Fireside to generate social media and communications content for your organisation. You agree not to:
- Use the Service to generate misleading, defamatory, or illegal content.
- Attempt to reverse-engineer, scrape, or abuse the API.
- Share your account credentials or resell access to the Service.
- Upload content you do not have the right to use.
- Use content from a connected source (Google Drive, GitHub, GitLab, Notion, Confluence, Grain, or a web page) unless you have the right to access and use that content.
Recorded calls. Connecting a call recorder such as Grain gives Fireside access to recordings of people who do not have Fireside accounts. By connecting it you confirm three things: the calls were recorded lawfully, the participants knew they were being recorded, and you are allowed to pass the recordings to a supplier who will generate content from them. If a participant asks to be removed, tell us and we will delete the stored transcript and any clips cut from that call.
3. Content Ownership
You own the content you upload (transcripts, documents, recordings) and the content Fireside generates for you, including any video clips cut from your source material. We do not claim ownership of your content. To provide the Service we pass your content through third-party AI services, currently Anthropic's Claude API. Our Privacy Policy covers what that involves.
4. Billing & Refunds
Fireside's self-service software may be available on free or paid plans to existing or invited accounts. Paid software subscriptions are billed monthly via Stripe. You can cancel at any time, and access continues until the end of the billing period you have paid for. Refunds are handled case by case; contact sean@fromfireside.com.
The founder-led setup and operating engagement described on our pricing page is governed by the separate agreement we sign for that engagement. Where that agreement and these terms disagree, the engagement agreement wins.
5. Service Availability
We aim to keep Fireside available and reliable, but we do not guarantee 100% uptime. The Service is provided "as is" without warranties of any kind. We may modify, suspend, or discontinue features with reasonable notice.
6. Termination
You can delete your login at any time from the Settings page. We may suspend or terminate accounts that violate these terms. Closing a login does not automatically delete workspace records, which may be shared with other members. Our Privacy Policy explains how to request removal of stored content.
7. Limitation of Liability
To the maximum extent permitted by law, Fireside Systems Pty Ltd shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability is limited to the amount you have paid us in the 12 months preceding the claim.
8. Changes to These Terms
We may update these terms from time to time. Material changes will be communicated via email or an in-app notice. Continued use of the Service after changes constitutes acceptance.
9. Governing Law
These terms are governed by the laws of Australia. Any disputes will be resolved in the courts of New South Wales, Australia.
